A 24-year-old man died after falling from a hiking trail while trying to retrieve a friend’s hat. This is the third death on Mount Olomana’s third peak since 2011. Many people flock to Hawaii to explore its natural beauty – whether hiking, exploring the hot springs, swimming in the ocean or sport fishing.
However, these activities are not without risk. In dangerous areas, tourists and others must use care and heed warnings. In general, no liability exists against property owners, including the state of Hawaii or other governing body, where trails and danger spots are adequately marked. But, should the owner of the land fail to notify of unreasonable danger, a claim for premises liability may exist. Further, should a tour guide or group deviate from approved safe routes, and a customer sustains injury, it may be possible to bring a cause of action for personal injury or negligence.
